Terms of Service

1. Acceptance of Terms

By engaging the services of VeloraPixelFoundry, located at Rua Rio Chança, Lote 512 B, Boa Água, 2975-138 Quinta do Conde, Portugal, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not proceed with our services.

2. Scope of Services

VeloraPixelFoundry provides web development, design, optimization, and related digital services as described in individual project proposals and statements of work. The scope of each engagement is defined in the respective project agreement. Any work outside the agreed scope will require a separate written authorization.

3. Payment Terms

  • Invoices are payable within 14 days of issuance unless otherwise agreed in writing
  • Projects exceeding €2,000 require a 50% upfront deposit before work commences
  • Late payments incur a statutory interest rate of 4% per annum as per Portuguese law
  • All prices are quoted in EUR and are exclusive of VAT unless explicitly stated

4. Intellectual Property

Upon full payment, all deliverables and associated intellectual property rights are transferred to the client. VeloraPixelFoundry retains the right to display completed work in portfolio materials unless the client objects in writing within 30 days of project delivery. Pre-existing code libraries, frameworks, and tools used during development remain the property of VeloraPixelFoundry.

5. Project Timelines

Timelines provided in project proposals are estimates based on current workload and assumed client responsiveness. Delays in client-provided materials, feedback, or approvals will result in corresponding schedule extensions. VeloraPixelFoundry will communicate any anticipated delays promptly and propose revised timelines.

6. Warranty

VeloraPixelFoundry provides a 90-day warranty on all deliverables from the date of final delivery. During this period, any defects attributable to our workmanship will be resolved at no additional cost. The warranty does not cover issues arising from third-party modifications, hosting environment changes, or misuse of delivered systems.

7. Limitation of Liability

To the maximum extent permitted by Portuguese law, VeloraPixelFoundry's total liability for any claim arising from or related to these services shall not exceed the total fees paid by the client for the specific project giving rise to the claim. VeloraPixelFoundry shall not be liable for indirect, incidental, or consequential damages.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Setúbal, Portugal.

Refund Policy

1. General Refund Conditions

VeloraPixelFoundry is committed to delivering high-quality web development services. Refunds are evaluated on a case-by-case basis in accordance with Portuguese consumer protection law (Código do Consumidor) and the EU Consumer Rights Directive.

2. Deposit Refunds

The 50% deposit required for projects exceeding €2,000 is refundable under the following conditions:

  • Full refund if the project is cancelled before any development work has commenced
  • Partial refund proportional to undelivered work if cancelled during early project phases
  • No refund if cancellation occurs after significant development milestones have been completed

3. Completed Project Refunds

For completed projects, refunds may be issued if:

  • Deliverables substantially fail to meet the agreed specifications outlined in the project proposal
  • Critical defects are identified within the 90-day warranty period and remain unresolved after reasonable remediation attempts
  • Services were not delivered within the agreed timeframe due to reasons attributable solely to VeloraPixelFoundry

4. Non-Refundable Items

The following are not eligible for refund:

  • Work completed and accepted by the client during the project lifecycle
  • Third-party licensing fees, domain registrations, or hosting charges already incurred
  • Consultation fees for advisory services already rendered
  • Scope changes requested by the client after initial approval

5. Refund Process

To request a refund, contact VeloraPixelFoundry at [email protected] with your project reference and a detailed description of the issue. Refund requests are reviewed within 5 business days. Approved refunds are processed within 14 business days to the original payment method.

6. Dispute Resolution

If a refund request is denied and you believe the decision is unjust, you may escalate the matter to the Portuguese Consumer Dispute Resolution Centre (Centro de Resolução de Litígios de Consumo) or seek mediation through the European Online Dispute Resolution platform at https://ec.europa.eu/odr.
